User Conference Keynote Speaker Emphasizes the Power of Documentation
Princeton, NJ, November 15th, 2007 - While many different lessons were learned at Datamatics 15th Annual TC-1 User Conference, perhaps none were as valuable as those presented by Keynote Speaker, Evan Shenkman. As an attorney with Ogletree, Deakins, Nash, Smoak, & Stewart, P.C,. a law firm that specializes in employee litigation, Shenkman stressed the importance of documentation, which he described as one of the most critical aspects of HR compliance.
At the conference, Shenkman presented an in-depth look at both the reasons for and the results of employee litigation against former employers. He cited many cases of costly judgments against businesses by juries that felt the employers acted unfairly. The recent $11.6 million judgment against Isiah Thomas and Madison Square Garden was a recent, expensive example of the growing trend of employee litigation. Most of the examples given by Shenkman could have been avoided if employers had good handbooks and observed simple rules themselves. A good handbook will inform applicants/employees of what is expected of them, help employers make better hiring decisions, spell out the appraisal process, support disciplinary action, spell out work conditions, enumerate required training and education, observe ADA/FMLA and other Federal, State, and Local government requirements, and foresee and forestall problem issues. In addition, Markert recognized that many firms, even those with over a hundred employees, have no human resources department or trained human resources professional on staff.
